Workers' Compensation ? Have You Been Injured on the Job ...

Many people believe that if you are hurt on the job, and if your employer refuses to pay for your injuries that you are out of luck, and out of options. ?This is not true. ?In fact, many workers who have legitimate workers? compensation?claims struggle financially while wondering how they are going to afford to pay their bills and feed their families.

According to Indiana law, a worker is entitled to recover from:

Basically, the workers? compensation system is a compromise between employers and employees. ?For employees, the system provides a much more efficient remedy than the traditional tort (personal injury) system. ?The workers? compensation system is designed to establish a baseline of support immediately ?for the injured worker while the worker recovers and during the time the worker ?is unable to work. ?In addition, the system provides that the employer (or its workers? compensation insurance carrier) must pay for all medical expenses reasonably necessary for treatment of the condition. ?A typical personal injury case takes between two (2) and five (5) years to reach a resolution, while the worker is left without funds to support him or herself and is unable to work.

For employers, this eliminates the excessive awards that juries are infamous for sometimes awarding to plaintiffs. ?In personal injury cases, plaintiffs are not limited to recovering for the actual injury they suffer, but are also sometimes entitled to recover for pain and suffering, emotional distress, and punitive damages. ?In workers? compensation on the other hand, injured workers are only entitled to recover for the actual economic losses that they suffer that are directly related to the injury. ?The award is not based upon the what the employer did or failed to do that caused the injury. ?It is a no-fault system, where if the criteria are met, the employer is automatically liable for the injury that took place. ?Except in certain limited circumstances, an employee cannot sue his or her employer for an injury that occurred on the job.

First of all, in order to be entitled to compensation, the injury?must arise out of an employer-employee relationship. ?Independent contractors are not covered under the workers? compensation system. ?This means that independent contractors may sue the parent company for negligence instead of being awarded compensation through the workers? compensation system. ?However, the determination as to whether you are an independent contractor or an employee is sometimes a highly complex legal determination. ?If you are unsure whether you are an independent contractor or an employee, please consult a licensed Indiana lawyer immediately.

If the worker is found to have been an employee, and if the injury occurred within the scope and course of his or her employment, the worker will be entitled to several types of compensation. ?The first kind of compensation is called, ?Temporary Total Disability? or TTD. ?In Indiana, this calculation is relatively simple: two thirds (2/3) of the worker?s average earnings over the past three (3) months. ?For example, if a worker earns (over the most recent three (3) months) an average of three hundred dollars ($300) per week, he or she would be entitled to two hundred dollars ($200) compensation per week while he or she is unable to work and while he or she is recovering from the injury. ?Assuming at some point that the worker is able to fully recover and resume his or her full duties, the compensation ends there. ?If, however, the injured worker does not fully recover and cannot perform the full duties of his or her original job, the injured worker will be entitled to other compensation, known as ?Permanent Partial Impairment? or PPI.

In addition to receiving compensation for Temporary Total Disability (TTD) a worker may be entitled to Permanent Partial Impairment (PPI) based upon the loss or limited use of a particular body part. ?PPI begins upon reaching ?Maximum Medical Recovery? or MMR. ?MMR?occurs when the injured worker has received any and all necessary and reasonable medical treatment, and has reached a point that his or her condition will no longer continue to medically improve. ?At this point, the worker will be entitled to a lump sum payout based upon his or her reduced capacity to work, and is based upon a highly complex formula that depends on the type of injury and the body part(s) involved.

NEW YORK (AP) ? Facing a certain backlash from Washington and beyond, American International Group won't be joining a shareholder lawsuit against the U.S. government.

AIG was legally obligated to consider joining the lawsuit being brought against the government by former AIG Chief Executive Maurice Greenberg, who claims that the terms of the $182 billion bailout weren't fair to AIG shareholders.

The prospect of AIG joining the lawsuit had already triggered outrage. A congressman from Vermont issued a statement telling AIG: "Don't even think about it."

AIG was rescued from the brink of collapse by the U.S. government at the height of the 2008 financial crisis. The insurance company nearly imploded after making huge bets on mortgage investments that later went wrong.

The company currently has an ad campaign themed "Thank You America."

Asian shares capped ahead of earnings reports

TOKYO (Reuters) - Asian shares steadied on Tuesday but prices were capped by investor caution ahead of corporate earnings season for the last quarter of 2012 and the European Central Bank's policy meeting later in the week.

U.S. stock prices retreated from five-year highs on Monday, spurring selling of oil, gold and other risky investments and reviving some safety bids for U.S. and German government debt.

U.S. earnings season unofficially kicks off when aluminium maker Alcoa reports its results after Tuesday's market close.

MSCI's broadest index of Asia-Pacific shares outside Japan inched up 0.1 percent, after drifting lower the previous session when investors took profits from the new year rally, which lifted the index more than 2 percent in the first week of 2013.

Australian shares were up 0.2 percent, near a 19-month high, with miners supported by firmer iron ore prices and signs of improved growth in China.

China's annual economic growth may have quickened to 7.8 percent in the fourth quarter, a Reuters poll showed, snapping seven straight quarters of weaker expansion, but the recovery is likely to be tepid and the economy may need continued policy support. The data is due out on January 18.

South Korean shares opened down 0.4 percent, after Samsung Electronics , the world's top maker of memory chips and handsets, estimated its October-December operating profit at a record 8.8 trillion won. Samsung's guidance, coming ahead of full quarterly results by January 25, was in line with forecasts.

"Trading for the new year kicked off in full force yesterday and it is natural for investors to start cautiously with profit taking from the new year's rally," said Yuji Saito, director of foreign exchange at Credit Agricole in Tokyo.

"I expect position adjustments to continue ahead of key events such as the ECB meeting and earnings reports starting with Alcoa," Saito said.

He said the euro could still push higher to around $1.3150 ahead of the ECB meeting.

Saito said the dollar may face selling pressure against the yen, having scaled its highest since July 2010 at 88.48 on Friday, up about 7 percent over the past month. But he said support was seen firm at 86.50 yen.

The dollar was down 0.5 percent to 87.32 on Tuesday.

Japan's benchmark Nikkei stock average opened 0.5 percent lower, after snapping a five-session winning streak on Monday when a pause in the yen's weakness triggered profit-taking on exporters.

The euro rose against the dollar on Monday on bets the ECB might refrain from signalling more interest rate cuts when it meets on Thursday. The single currency steadied around $1.3121 early on Tuesday.

"With a lighter data schedule, investors are likely to focus on the central bank communication this week. We look for unchanged policy at the ECB governing council meeting on Thursday." said Barclays Capital analysts in a research note.

U.S. crude inched up 0.1 percent to $93.28 a barrel.

Mechanism of hearing is similar to car battery, researcher learns

Jan. 7, 2013 ? University of Iowa biologist Daniel Eberl and his colleagues have shown that one of the mechanisms involved in hearing is similar to the battery in your car.

And if that isn't interesting enough, the UI scientists advanced their knowledge of human hearing by studying a similar auditory system in fruit flies -- and by making use of the fruit fly "love song."

To see how the mechanism of hearing resembles a battery, you need to know that the auditory system of the fruit fly contains a protein that functions as a sodium/potassium pump, often called the sodium pump for short, and is highly expressed in a specialized support cell called the scolopale cell.

The scolopale cell is important because it wraps around the sensory endings in the fly's ear and makes a tight extra-cellular cavity or compartment around them called the scolopale space.

"You could think of these compartments as similar to the compartments of a battery that need to be charged up so they can drive electrons through circuits," says Eberl, whose paper made the cover of the journal Proceedings of the National Academy of Sciences. "In the auditory system, the charge in the scolopale space drives ions, or electrically charged atoms, through membrane channels in the sensory endings that open briefly in response to activation by sounds.

"Our work shows that the sodium pump plays a particularly important role in this cell to help replenish or recharge this compartment with the right ions. The human ear also relies on a compartment called the scala media, which similarly drives ions into the sensory cells of the ear," he says.

How was the research done? This is where the fruit fly love song comes into play.

Testing whether or not a fruit fly can hear the love song -- a sound generated by a vibrating wing -- enables Eberl to learn whether electrical recharging is occurring in the fly ear. The fruit fly love song played a role in the research by stimulating the fly to move whenever a sound was emitted and received.

"In these experiments we tested the fly's hearing by inserting tiny electrodes in the fly's antenna, then measuring the electrical responses when we play back computer-generated love songs," he says.

Eberl notes there are many similarities between fruit fly and human mechanisms of hearing. That means his work on the fly model to identify additional new components required for generating the correct ion balance in the ear will help scientists to understand the human process in more detail.

Eberl's co-authors on the paper areMadhuparna Roy, postdoctoral associate at the University of Pittsburgh, and Elena Sivan-Loukianova, UI biology research scientist. At the time of the research, Roy was a graduate student in the UI Graduate College studying in the College of Liberal Arts and Sciences Department of Biology.

The title of the paper, published last week, is "Cell-type-specific roles of Na+/K+ ATPase subunits in Drosophila auditory mechanosensation."

The research was supported by the National Institutes of Health (grant number 5P30DC010362-03) and the Iowa Center for Molecular Auditory Neuroscience at the UI (grant number P30DC010362).

Fewer people are dying from cancer in the United States, but a government report published Monday warned that a lack of preventative measures could stem a steady decline in mortality rates.

Mortality rates have been falling since the early 1990s. The study found that from 2000 to 2009, cancer death rates decreased by 1.8 percent per year among men and by 1.4 percent per year among women.

Death rates among children up to 14 years of age also continued to decrease by 1.8 percent per year, according to the Annual Report to the Nation on the Status of Cancer.

Overall cancer incidence rates fell 0.6 percent per year among men from 2000 to 2009, while rates were stable among women and rose by 0.6 percent per year among children under the age of 15.

?While this report shows that we are making progress in the fight against cancer on some fronts, we still have much work to do, particularly when it comes to preventing cancer,? said Thomas Frieden, director of the Centers for Disease Control and Prevention.

?For example, vaccinating against (the sexually transmitted disease) HPV can prevent cervical cancer, but, tragically, far too many girls are growing into adulthood vulnerable to cervical cancer because they are not vaccinated.?

The study found that fewer than half of US girls aged 13 to 17 had received at least one dose of the vaccine and only 32 percent had received all three recommended doses in 2010.

This falls well short of the government?s targets and of vaccination rates of 50 to 85 percent in neighboring Canada and of more than 70 percent in the United Kingdom and Australia.

It comes as HPV-associated cancer rates are on the rise.

?The continuing drop in cancer mortality over the past two decades is reason to cheer,? said John Seffrin, chief executive officer of the American Cancer Society, which co-authored the study.

?The challenge we now face is how to continue those gains in the face of new obstacles, like obesity and HPV infections.

?We must face these hurdles head on, without distraction, and without delay, by expanding access to proven strategies to prevent and control cancer.?

The report also found that death rates among men decreased for 10 of the 17 most common cancers (lung, prostate, colon and rectum, leukemia, non-Hodgkin lymphoma, kidney, stomach, myeloma, oral cavity and pharynx and larynx) and increased for melanoma of the skin and cancers of the pancreas and liver.

Death rates for women decreased for 15 of the 18 most common cancers (lung, breast, colon and rectum, ovary, leukemia, non-Hodgkin lymphoma, brain and other nervous system, myeloma, kidney, stomach, cervix, bladder, esophagus, oral cavity and pharynx, and gallbladder) and increased for cancers of the pancreas, liver and uterus.

Meanwhile, incidence rates for women decreased for seven of the 18 most common cancers (lung, colon and rectum, bladder, cervix, oral cavity and pharynx, ovary and stomach), and increased for seven others (thyroid, melanoma of the skin, kidney, pancreas, leukemia, liver and uterus).

Incidence rates were stable for the other top 17 cancers, including breast cancer in women and non-Hodgkin lymphoma in men and women.

Cancer kills more than 1,500 people a day in the United States. That?s 301,820 men and 275,370 women in 2012, according to the latest estimates by the American Cancer Society.

About 1.6 million Americans are diagnosed with cancer every year.

IBM spends over $1.5B every quarter in research and development (R&D) expenses. SAP? Closer to $700M. Oracle? Assuming we don't count the tens of billions it spends buying other companies, its actual quarterly R&D budget comes in just over $1B - around $900M. Microsoft, which has printed billions of dollars in profit each quarter for eons, spends more than them all, topping $10B each year.

And yet not one of these companies is responsible for the biggest advances in enterprise technology in the past decade. ?Cloud computing, Big Data, mobile... they're all being invented elsewhere, not by the enterprise behemoths.

Maybe they're doing it wrong?

Lots Of R, Little D

Take the cloud, for example. Microsoft claims to invest 90% of its R&D budget on cloud computing, but it is Amazon, Microsoft's penny-pinching, book-retailing neighbor, that sets the terms for innovation in cloud computing. Amazon launched EC2 back in 2006, when it was spending a measly $132M or so each quarter on R&D.?

Even if we dismiss Amazon, where else are we seeing other cool advances in cloud computing? Netflix, for one, which just released Janitor Monkey to help Amazon Web Services (AWS) users dispose of their unused AWS resources, and the video company previously released Chaos Monkey, which helps enterprises plan for and architect around cloud failure.

Notice the word I used? "Released." It means these tools were open sourced, not put out for sale. That's how innovation seems to happen in the 21st Century.

In large part innovation comes with an open-source license because it's a by-product of businesses that heavily rely on technology, but don't actually sell technology. ?It's 'trickle-down innovation' from the web business community.

VMware's Brad Hedlund spotlighted this trend back in 2011, when the enterprise awoke to discover it had problems that the web giants had already solved:

As properties such as Yahoo!, Google, Facebook, Amazon became great successes, their architects and software engineers realized that they had moved mountains...The tremendous problems of efficiently running large scale applications on low cost infrastructure had been solved... At the very same time, enterprise IT begins to encounter some of the very same problems solved by the large web provider, such as scalable data warehousing and analytics (so called ?Big Data?). Additionally, the software driven distributed systems that solve problems of infrastructure efficiency and management at very large scale could also be applied to infrastructure at a smaller enterprise IT scale (why not?). And finally, the cost savings of an application infrastructure designed to operate on low cost commodity hardware can be realized at any scale, large web or enterprise IT.

Filling The R&D Gap

Companies like Cloudera, DataStax and others stepped into this gap, taking the open source (or, in the case of some of Google's research, open knowledge) projects from the web and applying them to the enterprise in the form of Hadoop, Storm, NoSQL databases, etc. ?All of it developed at a comparative pittance to enterprise incumbents' R&D budgets. ?All of it available free of charge on commodity hardware.?

As an industry, we're richer for such open source innovation. ?Ironically, so are the enterprise IT vendors, who are investing tens to hundreds of millions of dollars in Hadoop and other open source data and cloud innovations, even as they continue to sink tens of billions of dollars into their homegrown R&D. Maybe it's time for them to reevaluate how they do R&D. ?Maybe, like Facebook?or Twitter, they should release their R&D on GitHub as open-source code. ?At the least they could, like Google, centralize their research on the web, making it easily available to all.

Maybe, just maybe, they'd realize that it doesn't actually matter how much money a company spends on R&D. ?What matters is whether it can execute and turn ideas into winning products, as Brad Reed argues, and whether it can help foster community around promising open source efforts. ?

This is what new enterprise IT - Facebook, Twitter, Google and Yahoo - demonstrates. ?It remains to be seen if IBM, Microsoft and other traditional IT vendors are paying attention. ?Unless they do, they'll lose relevance as a new breed of innovative startups emerge to claim the strategic largesse of CIOs' budgets.

A recent poll showed that Hillary and Bill Clinton are the most popular politicians in America. How did America's top political couple come to have such high-flying ratings?

Though Secretary of State Hillary Rodham Clinton's return to work next week will be brief, given President Obama?s nomination of John Kerry to replace her as secretary of State, it comes amid an aura of national popularity, respect, and even fascination.

An NBC News/Wall Street Journal poll in December found that Secretary Clinton and her husband, the former President Clinton, are America?s two most popular politicians. At the same time, a Bloomberg poll found that 70 percent of Americans view Secretary Clinton favorably ? an astounding number given the country?s hyperpartisan divide.

What explains the high-flying ratings enjoyed by Bill and Hill, as Washington columnists prefer to call them?

Some pundits speculate that Secretary Clinton?s ?relegation? to the relatively noncontroversial global stage of international issues has allowed her to win approving nods from Democrats and Republicans alike.

Others say it?s simply because the Clintons are so ubiquitous, with Secretary Clinton traveling up a storm representing America to the world and Mr. Clinton holding court during this past election cycle ? first at the Democratic National Convention, then on the stump ? on behalf of Mr. Obama.

But as The Washington Post noted recently as it marveled over the ?good year? the Clintons have enjoyed: ?[U]biquity usually breeds fatigue from the public, not more excitement.?

So why doesn't America have Clinton fatigue?

In Secretary Clinton?s case, Americans appear to admire her work ethic and her ability to reinvent herself ? and not just to make do with the hand dealt her, but to employ it with a flourish.

In announcing Clinton?s imminent return after being hospitalized for a blood clot, State Department spokeswoman Victoria Nuland said that the secretary is ?raring to go.? It may have sounded corny, but it also rang true. Anyone who kept a close eye on Clinton?s daily calendar over the past four years could not help but believe it.

It also sounded right when Ms. Nuland added that Clinton remained ?committed to testifying? to Congress on the Benghazi attack, which occurred on her watch and cost the lives of four Americans, including the US ambassador to Libya, Christopher Stevens.

And then there is the matter of personal reinvention.

When Secretary Clinton emerged Wednesday from a New York hospital, husband and daughter Chelsea at her side, she smiled behind dark glasses ? the same dark glasses, it seems, as the ones she wore in the now-famous photo of her on a military plane looking over her BlackBerry. It was a reminder of the considerable distance traveled from the frumpy pantsuits of her unsuccessful 2008 presidential campaign to the ?cool Hillary? of 2012 Internet memes.

More substantial, is how she picked herself up from the 2008 defeat and effectively ? and cheerfully ? put herself at the service of the man who dealt her that blow, in the role of the nation?s top diplomat. ?

As she visited (and in some cases revisited) the world?s emerging democracies, Clinton must have told a thousand times the story of how, after battling and then losing to then-Senator Obama, she now worked for him ? and how overcoming political rivalries for the national good was an essential ingredient of a successful democracy.

That ability to turn her largest political defeat into an asset ? the lemons-to-lemonade analogy, to use an old phrase ? may be the trait that impresses one most about Clinton.?

LOS ANGELES (AP) ? "Lincoln" and "Zero Dark Thirty" are adding to their front-runner status for Hollywood's awards season.

The two dramas earned nominations from the Writers Guild on Friday for outstanding screen writing.

"Lincoln" is up for adapted screenplay, along with "Argo," ''Silver Linings Playbook," ''Life of Pi" and "The Perks of Being a Wallflower."

"Zero Dark Thirty" was nominated for original screenplay, along with "Flight," ''Looper," ''The Master" and "Moonrise Kingdom."

In the documentary category, "The Central Park Five," ''The Invisible War," ''Mea Maxima Culpa, "West of Memphis," ''We Are Legion: The Story of the Hacktivists," and "Searching for Sugar Man" earned nominations.

Winners will be announced during simultaneous ceremonies in New York and Los Angeles on Feb. 17.

Atom smasher heading for two-year hiatus

The world's largest and most powerful atom smasher goes into a two-year hibernation in March, as engineers carry out a revamp to help it reach maximum energy levels that could lead to more stunning discoveries following the detection of a long-sought subatomic particle.

With the reopening of its $10 billion proton collider in early 2015, the stage will be set for observing more rare phenomena ? and unlocking more mysteries, said James Gillies, chief spokesman for the European particle physics laboratory known as CERN.

The Large Hadron Collider under the Swiss-French border will operate for two more months then shut down through 2014, allowing engineers to lay thousands more superconducting cables aimed at bringing the machine up to "full design energy," Gillies told The Associated Press on Friday.

Physicists at the European Center for Nuclear Research, known by its French acronym CERN, won't exactly be idle as the collider takes a break. There are still reams more data to sift through since the July discovery of a new subatomic particle called the Higgs boson, which promises a new realm of understanding of the universe.

For the next two months, the Large Hadron Collider will be smashing protons with lead ions, then undergo several weeks of testing before it shuts down. The collider launched in September 2008, but had to be switched off just nine days later when a badly soldered electrical splice overheated, causing extensive damage to the massive magnets and other parts of the collider 300 feet (100 meters) below the ground.

It cost $40 million to repair and improve the machine. Since its restart in November 2009, the collider has performed almost flawlessly and the power produced has been ramped up to ever-new record levels, creating a treasure trove of new data to sift through.

But because of the 2008 accident, the collider could only run at an energy level far below what it was designed to do. To fix that, Gillies said, engineers over the next two years will install 10,000 redesigned superconducting cables that connect between the magnets. That will vastly improve its capacity to simulate the moments after the big bang nearly 14 billion years ago.

"It will bring you more collisions. Which means that the more collisions you have, the more likely you are to see rare events," he said. "The Higgs particle was just one of many on the wish list that we'd like to find, so higher energy increases your discovery potential."

ABC's Susanna Kim reports: The job additions matched the expectations of economists. The Bureau of Labor Statistics also revised figures for October down to 137,000 from 138,000 and for November up to 161,000 from 146,000. Peter Hooper, chief economist with Deutsche Bank, said strength in the construction sector is offsetting weakness in the government sector. "For the 113th Congress, it is a time to rise," House Speaker John Boehner said in his opening remarks to the members of the 113th Congress yesterday. "When the day is over, and the verdict is read, may it be said that we well and faithfully did our duty to ensure freedom will endure and prevail."

It was a day of renewal on Capitol Hill as members, including the new freshman class, took the oath of office. But there is reason to believe the brief ceasefire between Democrats and Republicans won't last long.

Major battles await the 113th Congress, and they are likely to be as contentious as ever. Just look at yesterday's vote to re-elect Boehner as speaker, which ABC's Jonathan Karl described as the most dramatic vote for Speaker I have ever witnessed."

Boehner received only 220 votes of the 233 Republicans in the House - 13 abstained or voted for somebody else. Had he lost 17, he would not have won.

And that's just one example of rancor within the GOP's own caucus. What happens when the new Congress has to tackle thorny policy issues like the debt ceiling, immigration and gun control?

As we've noted here earlier this week, the fight over whether or not to raise the nation's borrowing limit will come to a head in a couple of months. As will the decision about how to handle the automatic cuts to defense and other programs that were put off temporarily. In fact, the fight over next fiscal cliff could wind up looking a lot like the first one.

And now, in the wake of last month's school shooting in Connecticut that killed 26 children and adults, there is the renewed push to change the country's firearms laws. As USA Today's Jackie Kucinch reported today, "Congress has not passed any significant gun-related regulations since 2007." http://usat.ly/UjlV5z

Yesterday Reps. Carolyn McCarthy, D-N.Y., and Diana DeGette, D-Colo., introduced new gun control legislation and several senators also plan to wade into the debate with bills of their own: "They include the Fix Gun Checks Act by Sen. Charles Schumer, D-N.Y., which would close loopholes that allow gun sales at shows without background checks and strengthen those checks. Sen. Dianne Feinstein, D-Calif., has said she will reintroduce a ban on the ownership on assault weapons," Kucinch reported.

Immigration reform will be high on the agenda too. As the Washington Post's David Nakamura and Tara Bahrampour note today, "The Obama administration's decision this week to ease visa requirements for hundreds of thousands of illegal immigrants represents its latest move to reshape immigration through executive action, even as the White House gears up for an uncertain political fight over a far-more-sweeping legislative package in the months ahead." http://wapo.st/1374Hsq

In his remarks yesterday, Boehner told members that the oath of office they take "makes no mention of party, faction, or title" and "contains no reference to agendas or platforms - only to the Constitution." A fitting sentiment to kick of the new Congress, but will anyone remember it a few weeks or even a few days from now?

Yet taken another way, that's an astounding number that only hints at the true tumult inside the House GOP caucus; this was a challenge lacking only a challenger to be credible. More broadly, it speaks to the crisis of leadership in Washington now - nobody, not Boehner, not his top deputies, not any Senate leaders, and often not the president himself - is in charge in the sense that he or she can truly move an agenda. Boehner, at least, has company.

OBAMA HAS A FATHER-DAUGHTER DAY IN PARADISE. ABC's Mary Bruce files this dispatch from Oahu: Over the past two weeks, President Obama has passed his days in Hawaii hitting the gym, golfing with friends and relaxing on the beach with his family. Today, he enjoyed some father-daughter time, bowling with Malia and Sasha and going out for Hawaiian shave ice, an annual tradition. After spending the afternoon at the bowling alley at the Marine Corps base at Kaneohe Bay, Obama and his daughters stopped at Island Snow Shave Ice, a small eatery in a shopping center near their Kailua vacation house. A long line quickly formed outside as onlookers tried to get a glimpse of the president in what was his first public appearance of his annual holiday vacation in his native state. After several minutes inside, Malia and Sasha and several other children, presumably family friends, emerged with cool treats in hand. CHRIS CHRISTIE'S $2 MILLION HAUL. New Jersey Gov. Chris Christie, who blasted members of his own party Wednesday for abandoning a $60 billion relief bill for superstorm Sandy victims, had a fruitful fundraising period, raising more than $2.1 million since he announced his re-election Nov. 26, ABC's Shushannah Walshe reports. The campaign pulled in the cash in 36 days and without a single fundraising event. Mike Duhaime, the spokesman for the campaign, wouldn't comment on specific breakdowns of the haul, but said it was 'a lot of different people, both small donors and large all over the country,' including 'all 21 counties in New Jersey.' 'The vast, vast majority came from within New Jersey, but there were [donors] from around the country,' Duhaime said. 'We feel great about it, but it was pretty much organic. Some came from the Web, some from word of mouth.' Duhaime added that the campaign sent out a small amount of direct mail to donors who gave to Christie during his 2009 campaign. It's notable that the funds came in during the holiday season and when the state is still reeling from Sandy, which slammed into New Jersey Oct. 29." http://abcn.ws/UJ9PzS

Chris Christie loves being able to show he is not part of the Washington problem, that he will defend the people of his state against the likes of Speaker John Boehner, R-Ohio. Just as Christie did not want to tarnish himself with the Mitt Romney brand last year, he does not want to tarnish his chances with the Boehner brand this year. Indeed, the only brand the governor is concerned with is the Chris Christie brand. But is there a risk in alienating Boehner and the Republican party? CLASSIC BIDEN ON DISPLAY AT CAPITOL SWEARING IN. Vice President Joe Biden turned on the charm and amped up the wit at the Senate mock swearing-in yesterday, schmoozing with senators' moms, doling out dating advice to one senator's granddaughter and offering some workout help to one new senator's family member, reports ABC's Arlette Saenz. As senators brought their families up to take photos with the vice president, Biden would always single out the mothers, directly calling them "Mom," embracing them as he said hello and touching some of their faces. When he greeted the mother of Sen. Deb Fischer, R-Neb., he told her, "You've got beautiful eyes, mom." "Mom, I'll see you in a little bit," Biden said to the mother of Sen. Bob Casey, D-Pa., as she walked away. "I hope I'll sneak over and see you." While Biden hugged the mother of Sen. John Barrasso, the Wyoming GOP senator made a joking dig at the vice president, telling him, "She liked [Dick] Cheney better, she told me." But while he seemed to flirt with the senators' mothers, he gave strict advice to the young women in the mix of family members, telling the granddaughter of Sen. Orrin Hatch, R-Utah, "No serious guys until you're 30." CHELSEA CLINTON SPEAKS UP. While Hillary Clinton was in the hospital it was daughter Chelsea - not the secretary of state or the former president Bill Clinton - who spoke for the family, notes ABC's Shushannah Walshe. She, along with the State Department, doled out what little information the family wanted to share in a series of tweets and when her mother was released from the hospital, it was Chelsea who delivered the thanks on behalf of her parents, tweeting her gratitude to the doctors as well as those who kept her mother in their thoughts while she recovered from a blood clot. When Hillary Clinton leaves office, possibly at the end of this month, it will be the first time since 1982 that a Clinton will not be holding a public office. The watch will be on whether Hillary Clinton makes another run for the White House in 2016, but almost inevitably people will also be watching to see if Chelsea Clinton decides to run for office, too. "Americans always look for dynasties: Bush, Kennedy, Cuomo, Clinton ? it's some kind of continuity. Mediocre job growth points to slow grind for U.S. economy

WASHINGTON (Reuters) - The pace of U.S. job growth slowed a bit in December, keeping the unemployment rate steady at 7.8 percent, but details of the Labor Department's U.S. employment report were fairly encouraging.

* Nonfarm payrolls increased 155,000, but job gains for the previous month were revised up to show 15,0000 more positions created than previously reported.

* Construction employment rebounded strongly, gaining 30,000 jobs after sagging 10,000 in November, reflecting increased residential construction activity as the housing market recovery gains traction.

* Manufacturing payrolls gained 25,000 after rising 5,000 in November. Manufacturing working hours increased, a positive sign for a sector that has been cooling in recent months. That helped to lift the overall average workweek to 34.5 hours from 34.4 hours in November.

* With workers putting in more time, the average hourly earnings increased 0.3 percent after rising by the same margin in November.

* More people entered the labor force, a sign of confidence in the jobs market, keeping the unemployment rate elevated. The household survey also showed a modest increase in employment, but more people reported they did not have jobs.

* The bad news is that government shed 13,000 jobs in December after a loss of 10,000 the prior month.

* Temporary help jobs, often seen as a harbinger for permanent hiring, fell in December and retail employment declined by 11,300 jobs after a hiring spree the previous months.
